Same-sex couple can seek damages from Kentucky clerk: U.S. appeals court Posted: 02 May 2017 12:01 PM PDT A federal appeals court on Tuesday revived a damages lawsuit against Kim Davis, the Kentucky county clerk who in 2015 refused to grant marriage licenses to same-sex couples because it conflicted with her Christian beliefs. The 6th U.S. Circuit Court of Appeals in Cincinnati said a lower court judge erred in finding that damages claims by David Ermold and David Moore became moot, after a new state law last July excused clerks like Davis, from Rowan County, from having to sign marriage license forms. While the couple eventually did get a license, a three-judge appeals court panel said they could sue over Davis' initial refusal to grant one, after the U.S. Supreme Court in June 2015 said the Constitution guaranteed a right to same-sex marriage. |

Officer Roy Oliver shot high school freshman Jordan Edwards with a rifle as he sat in a car with his two brothers and two other teenagers while it drove away from a party on Saturday night. Balch Springs police chief Jonathan Haber said Mr Oliver has been fired for violating department policies in the shooting, but said he could not reveal further details of the policies as the officer can appeal his dismissal. |

Don't worry, though — he made it out just fine. And he seems to have had an extremely fun experience. According to CBS News, the toddler climbed from the backseat into the front of his mother's unlocked car while she unloaded groceries at a store in Bude, United Kingdom. After she closed the trunk, but before she got back into the car, Brandon pushed the "lock" button. Whoops. Windows 10 S users will have to pay $50 to upgrade to Windows 10 Pro Posted: 02 May 2017 03:02 PM PDT On Tuesday morning in New York City, Microsoft unveiled a streamlined, simplified version of its latest operating system called Windows 10 S. Unlike other editions of the OS, Windows 10 S will only run apps from the Windows Store, making it speedier and more secure than Windows 10 Pro. It's the company's long-awaited answer to Chrome OS, but there's one key difference between the two platforms.
Any Windows 10 S machine can be upgraded to Windows 10 Pro for a one-time $49 fee. Once you upgrade, your computer will operate just like any other Windows 10 computer, capable of downloading and running apps from the internet. Microsoft can no longer guarantee that your computer will have as long a battery life or perform as well as it did on Windows 10 S, but it's always an option. Additionally, anyone who picks up a Surface Laptop (which runs Windows 10 S by default) will be able to switch to Windows 10 Pro for free as long as they do it before the end of 2017. They're already paying $999 for a new laptop, so it makes sense to waive the fee and let them do what they want. Even with the free upgrade for Surface Laptop owners, the optics for this decision are fairly horrid. Microsoft is trying to compete with Apple's MacBooks and Google's Chromebooks all at once and might finally have a laptop that can do so. Why nickel-and-dime consumers who buy Windows 10 S machines and then realize that the OS doesn't suit their needs? Windows 10 S has potential, but moves like this are bad for the operating system, bad for Microsoft and bad for consumers. |

Maybe Tim Cook should blame the iPhone 7’s three-year-old design for declining sales Posted: 03 May 2017 06:18 AM PDT Apple on Tuesday afternoon reported fiscal second-quarter earnings that were largely in line with expectations. Revenue climbed to $52.9 billion from $50.2 billion in the year-ago quarter, and net profit came in at $11 billion. Second-quarter guidance that missed analysts' consensus estimate was largely responsible for driving Apple shares down in after-hours trading, but another troubling line item offered some cause for concern: Sales of the iPhone, Apple's chief moneymaker, dropped to 50.76 million units from 51.2 million units in the same quarter last year. Chief executive Tim Cook was quick to blame the rumor mill for the continued slow-down in iPhone sales. Of course, there is no question that rumors of a completely redesigned iPhone 8 played a role in convincing some people to hold off on upgrading old iPhones. But there's also no question that something else is responsible in part for slowing iPhone sales, and we all know that something else is the iPhone 7. A narrative formed on gadget blogs ahead of Apple's iPhone 7 and iPhone 7 Plus unveiling last September. Because the new iPhones featured a design that looked just like the iPhone 6 and iPhone 6s, many bloggers labeled the phones "boring." Once the new phones were released, anyone who actually picked up a new iPhone 7 or 7 Plus and used it instantly knew it wasn't boring at all. But there's little question that people continued to judge these books by their covers following their launch. Apple took a chance when it decided to recycle the same iPhone design for a second year. Since the launch of the iPhone 3GS in 2009, Apple has trained its user base to expect a fresh new iPhone design every other year. Since 2015 was an "S" year, 2016's iPhone 7 should have offered users a new look and feel in addition to all the new features and upgrades. Instead, we got the same iPhone for a third consecutive year, but with a fresh coat of paint. Well, it turns out that a fresh coat of paint wasn't enough for some customers. "In general, what we are seeing, we're seeing what we believe to be a pause in purchases on iPhone, which we believe are due to the earlier and much more frequent reports about future iPhones," Cook said on Tuesday's earnings call. "And so that part is clearly going on and it could be what's behind the data. I don't know but we are seeing that in full transparency." Again, there is absolutely no question that the rumor mill shares the blame for the continued decline in Apple's iPhone business. The same can be said each and every year. The iPhone is the most beloved consumer electronics device in the world, and people want to know what's coming next. Details begin to leak more than a year before each new iPhone launches, and the iPhone 8 was no different. This time around, however, the details that have leaked so far paint a picture of an exciting new iPhone design made of glass and stainless steel with an OLED display, ultra-thin bezels, and a Touch ID fingerprint scanner embedded in the screen itself. Meanwhile, the latest iPhones sitting on store shelves look just like the iPhones from 2015, which look just like the iPhones from 2014. 50.76 million iPhones is a whole lot of iPhones. Apple earned $11 billion in profit last quarter. The company's cash stockpile grew to $256.8 billion — that's more than a quarter of a trillion dollars. It was a massive, massive quarter. But if you're going to attempt to explain away the continued slide in iPhone sales, not mentioning Apple's three-year-old iPhone 7 design is oblivious at best and disingenuous at worst. |
